Destefano, as an individual and personal representative of his mother,
Carolina Destefano, sued the following entities for the corresponding
claims:
The Adventist Group
- ONE COUNT OF DEFAMATION - ADVENTIST HEALTHCARE
SYSTEM;
- ONE COUNT OF DEFAMATION - FLORIDA HOSPITAL;
- ONE COUNT OF DEFAMATION - ADVENTIST
CARE CENTERS;
- ONE COUNT OF BATTERY - ADVENTIST CARE
CENTERS;
- ONE COUNT OF DEFAMATION - SUNBELT HEALTH
CARE & SUBACUTE CENTER;
- ONE COUNT OF BATTERY - SUNBELT HEALTH
CARE & SUBACUTE CENTER;
- ONE COUNT OF CIVIL CONSPIRACY - THE ADVENTIST
GROUP;
and
- ONE COUNT OF CIVIL CONSPIRACY - ORLANDO
REGIONAL MEDICAL CENTER
At trial, Mr. Destefano alleged that he was defamed
by individuals from the Adventist Group when they falsely accused
him of sexually molesting and battering his terminally ill mother,
i.e., kissing his mother on the lips with his mouth open, lying
fully on top of her, inserting his finger into her rectum until
she presented with rectal bleeding, kneeing her in the back, continuously
inserting food into her mouth until she began to gag, and literally
dragging her around the floor until she bled.
Mr. Destefano alleged his mother, Carolina Destefano,
was battered by individuals from the Adventist Group when they falsely
reported that Mrs. Destefano presented with rectal bleeding after
her son was witnessed inserting his finger into her rectum. Mr.
Destefano alleged that to bolster this false report, individuals
from the Adventist Group withdrew blood from Carolina Destefano
and planted it at her vaginal / rectal area.
Based on the false reports put forth by individuals
from the Adventist Group, Carolina Destefano was transferred or
ORMC's emergency department with a RECTAL ANAL HEMORRHAGE.
Evidence was presented that following Carolina
Destefano's arrival at ORMC, individuals from the Adventist Group
communicated on 11 (eleven) different occasions with individuals
from ORMC (see CALL
CHART).
Mr. Destefano alleged that in these communications
individuals from ORMC conspired with individuals from the Adventist
Group to falsely accuse him of molesting his terminally ill mother.
ORMC's specific documentation was that Carolina
Destefamo was a comatose cachectic patient "whose normal state
is with her mouth open." Mr. Destefano alleged that it was
only after ORMC communicated with the Adventist Group that ORMC
reported Mr. Destefano was lying on top of his mother an French
kissing her.
ORMC reported in greater detail that Mr. Destefano's
lips surrounded his mothers open mouth and lips multiple times with
the duration of each kiss occurring 3 to 5 seconds, and that "this
episode was considered to be a passionate kiss as a romantic couple
would kiss one another."
